Building Regulation TGD L Buildings other than Dwellings

NZEB IMPLICATIONS AND KEY DATES

The new TGD L 2017 for Buildings other than Dwellings was formally published on 22nd December 2017.

The publication of this Standard brings into Irish Legislation EU Energy Performance of Buildings Directive 2010/31/EU of 19th May 2010, which covers NZEB requirements for Buildings.

Key Dates:

  • This new Standard TGD L 2017 applies to all Buildings other than Dwellings where work, material alteration or major renovation works commence on or after 1st January 2019.
  • TGD L 2008 ceases to have effect from 31st December 2018. However, TGD L 2008 may still be used where

Work, Material Alteration or change of use has commenced on or before 31st December 2018

       or

Where Planning approval or permission for Buildings has been applied for on or before 31st December 2018 and substantial work has been completed by 1st January 2020.

“Substantial work has been completed” means that the structure of the external walls has been erected.

The new TGD L 2017 does not differentiate between Buildings and Buildings owned or occupied by Public Authorities.

Therefore, compliance with the Interim NZEB Performance Specification for new Buildings other than Dwellings owned and occupied by Public Authorities as issued in December 2016 is not necessarily a statutory requirement and it is up to each Public Body if they want to comply with the interim Specification in advance of the published dates for all Buildings as set out in the TGD L 2017 above.

 

Building Regulation TGD L for Dwellings – UPDATE

It is planned to publish a TDG L 2018 for Dwellings containing the detailed requirements for NZEB Dwellings in Q1 2018 for Public Consultation.

This TGD L for Dwellings will contain the implementation date for NZEB Dwellings which is planned to apply to all Dwellings commencing Construction from early 2019.

The NZEB numerical indicator is already published “for information purposes” in the current TGD L Dwellings 2011 (amended 2017) as an MPEPC of 0.30 and an MPCPC of 0.35.

Therefore, currently until TGD L 2018 is published there is no implementation dates for a Dwelling to be NZEB compliant and it is up to Local Authorities and private Developers to decide if they want to comply with NZEB in advance of the implementation of TGD L 2018.
